February 2011 Meeting
A. CONVOCATION:
1. The Canadice Town Board Meeting was held on February 14, 2011 at 7:30 pm at the Canadice Town Hall.
2. Roll call showed the following-

Councilman John O’Connor
Councilman William Hershey
Others Present: Six (6) guests/residents attended the Regular Town Board Meeting.
3. Salute to the Flag. Supervisor Singer also asked for a moment of silence in memory of Mr. Earl Mastin.
4. Approval of January 10, 2011 Regular Meeting Minutes-
Note: Minutes of the preceding meeting shall be approved without being read, unless the reading thereof is called for by a Member of this Board - the minutes are available for review at the Office of the Town Clerk.
Councilman Durkee motioned, Councilman O’Connor seconded, and it was unanimously carried to approve the minutes of the January 10, 2011 Regular Town Board Meeting.

B. PRIVILEGE OF THE FLOOR:
1. Mr. Michael Schaffron, LaBella Associates, P.C. Proposed Water District.
Mr. Schaffron indicated that funding is more difficult to obtain now, and it may be four to five years before that changes. Potential bond rates are about 6.2% if we have an A rating. Local banks may offer a better rate. For 2011 construction we are projecting $1,011 per year per EDU which covers debt reduction and water usage. There was some discussion to determine which properties could be included within the water district that are outside of the Honeoye Lakeshore District. We want to keep the district boundary at a point that will maintain a minimum of 35 psi during peak water flow.
-Supervisor Singer indicated that the Richmond Water Superintendent is looking into using VSD (variable speed drives) instead of a water tank. Mr. Schaffron explained how that works and that it isn’t viable for us. In our proposed district we would still need a water tank.
-Some questions regarding assessment issues need to be addressed. We need a firm definition of a dwelling unit, and if there are any parcels with two livable structures on the same parcel. Mr. Schaffron confirmed an access drive in the district is not assessed as a unit. After some discussion, it was felt the benefit per unit ratio would be the simplest to use.
-Mr. Schaffron will send six half scale revised maps and one full scale revised map. He also advises getting an attorney involved to start working on the project. We need correspondence from the Town of Richmond and the City of Rochester regarding operation of the district and availability of water.
-Councilman Virgil questioned the credit rating issue since we haven’t had a bond in a long time. Supervisor Singer talked to the Finance Director of Ontario County. The Director indicated that when our credit rating is checked, our books will be reviewed along with other contractual purchase agreements we have maintained.
-Mr. Schaffron thanked everyone for the time and he will be at the March meeting.
2. Mr. Ed Bott addressed the Board regarding snowmobile regulations. He mentioned that our law is consistent with the state law. Mr. Bott referred to OPRHP Law § 21.05, Definitions and OPRHP Law § 25.05, Operation on highways for some of his comparisons/information. Snowmobiles are limited use vehicles and are limited to operating with the flow of traffic, which he feels they have not been following. Another issue is the 25 mph speed limit in our local law that is not being followed. We don’t specify whether they can or can’t ride in the ditches; and we need to define inner or outer banks. There could be a liability to the Town if they have an accident. These laws need to be enforced by the Sheriffs Department. Supervisor Singer did try to contact Sheriff Povero and he was out of town at the time.
C. COMMUNICATIONS:

D. REPORTS:
1. Town Clerk/Tax Collector- Mrs. Eileen Schaefer.
a. The financial report for the Town Clerk/Tax Collector for the month of January was submitted (see T. C. file).
Councilman O’Connor motioned, Councilman Durkee seconded, and it was unanimously carried to accept the Town Clerk/Tax Collector’s report.

a. No report.
3. Code Enforcement Officer- Mr. Robert Best.

4. Planning Board- Mr. Theodore Mayhood.
a. The January draft minutes were submitted (see T.C. file).
b. Last minute changes are being made to the Comprehensive Plan and they do have it stored electronically. We will try to approve it at our February meeting.
5. Zoning Board of Appeals- Mrs. Linda Moorhouse.
a. The draft minutes of the December ZBA meeting were submitted (see T.C. file).
6. Highway Superintendent- Mr. Bruce Longbine.
a. Review of Equipment Replacement Schedule; in 2012 the Superintendent’s truck will be changed from diesel to gas to save money. Instead of recycling out the truck every two years, we can move the Superintendents truck over to the line for crew use and recycle the vehicle out every four years so there would be no future new replacement on a crew truck. The possibility of putting a plow on the truck was discussed also.
After some discussion, Councilman Hershey motioned and Councilman Durkee seconded and it was approved to proceed with the solicitation of a truck on state bid.

b. Pipe will be delivered tomorrow for the project on Townline Rd.
c. The well pump broke down and we replaced it today.

E. UNFINISHED BUSINESS:
1. Resolution Number 13 of 2011 – Adoption Of Fees Pertaining To The Licensing Of Dogs
Councilman Virgil motioned, Councilman Durkee seconded, and it was unanimously carried to approve the resolution.

WHEREAS, The Town Board of the Town of Canadice adopted Local Law Number 4 of 2010 entitled: A Local Law Amending Chapter 43, Animals, Dog Control and Licensing Law; and
WHEREAS, This Local Law requires the Town Board to establish certain fees and surcharges pertaining to the licensing of dogs; now, therefore, be it
RESOLVED, That the Town Board of the Town of Canadice hereby establishes the following fees and surcharges:
1. The license fee for a spayed or neutered dog shall be $11.50.
2. The senior resident (65 & over) license fee for a spayed or neutered dog shall be $6.50.
3. The license fee for an unspayed or an unneutered dog shall be $17.50.
4. The senior resident (65 & over) license fee for an unspayed or an unneutered dog shall be $12.50.
5. The surcharge if the dog to be licensed is altered shall be $1.00;
6. The surcharge if the dog to be licensed is not altered shall be $3.00;
7. Exempted from payment of the license fee and surcharge are applications submitted for a dog license for any of the following dogs, provided written documentation is provided with such application that certifies such dog as being any of the following: guide dog; hearing dog; service dog; war dog; working search dog; detection dog; police work dog; and therapy dog; and, be it further
RESOLVED, That these fees shall be effective as of January 1, 2011
2. Review Highway Shed Structure Evaluation.
a. The report is not completed yet. Supervisor Singer suggested a research committee be formed to work on this issue. Councilman Virgil, Councilman Durkee and Superintendent Longbine are the committee members.
3. Supervisor Singer mentioned opening the brush and leaf drop off at the old transfer site. 3,000 cubic yards of debris can be dumped twice a year.
4. Weed Harvesting Equipment. With repair work on the town machine handled in Richmond at the highway garage, quotes are still within what was budgeted. They are looking at purchasing a new machine to replace the second harvester and a trailer to haul it. Ontario County will look at funding for the second harvester.
F. NEW BUSINESS:
1. Resolution Number 14 of 2011 – Authorization To Execute A Maintenance Service Contract With Kistner Concrete Products, Inc. For The Town Hall And Town Shed Treatment Plants
Councilman Durkee motioned, Councilman Hershey seconded, and it was unanimously carried to approve the resolution.

WHEREAS, Canadice installed onsite home treatment plants at both the Town Hall and Town Shed facilities; and
WHEREAS, Said treatment plant requires annual maintenance to be in compliance with state codes and to ensure proper operation; and
WHEREAS, Kistner Concrete Products, Inc. has maintained the systems since they were installed; and
WHEREAS, The current maintenance contract expires on 1/10/11 and this Board desires to continue to have Kistner maintain the system; now, therefore, be it
RESOLVED, That this Board gives authorization to execute the maintenance contract renewal for a period of three years for the sum of $858; and, be it further
RESOLVED, That an Addendum be added to the contract requiring that all inspections be scheduled with the Town Code Enforcement Officer and are conducted with a representative of the Town in attendance; and, be it further
RESOLVED, That the Clerk of this Board send a signed copy of the agreement along with a certified copy of this resolution and payment to Kistner Concrete Products, Inc.; and, be it further
RESOLVED, That the Clerk retain a copy of said agreement for the Towns’ records.
2. Employee policy and procedure manual- Supervisor Singer would like to have a manual in place to cover all employees, not just the Highway Department.
3. Resolution Number 15 of 2011 – Resolution Of Sympathy
Councilman O’Connor motioned, Councilman Durkee seconded, and it was unanimously carried to approve the resolution.

WHEREAS, This Board was deeply saddened to learn of the death of Mr. Earl Mastin; and
WHEREAS, Mr. Mastin served this Town and its residents as Supervisor for 14 years from 1960 to 1973 living his entire life within the Town; and
WHEREAS, As Town Supervisor Mr. Mastin served on the Ontario County Board of Supervisors serving on the committee that established Finger Lakes Community College which has become a highly recognized educational institution; and
WHEREAS, In 2006 in honor of Mr. Mastin's 95th birthday, this Board declared March 31st as Earl Mastin Day; and
WHEREAS, Mr. Mastin also served the community as a member of the Board of Review for Canandaigua National Bank for 35 years; and
WHEREAS, Mr. Mastin shared many of his life experiences in articles he wrote for the Canadice Chronicle; and
WHEREAS, Mr. Earl Mastin left his mark in the history of this Town; and
WHEREAS, The entire Town of Canadice wishes to pay its respects to the memory of this fine citizen; now, therefore, be it
RESOLVED, That the Town Board of the Town of Canadice extends its sympathy to the family of Earl Mastin; and, be it further
RESOLVED, That this Resolution be entered as part of the permanent records of the Proceedings of the Town and be retained in its book of minutes forever; and, be it further
RESOLVED, That the Clerk of this Board send a certified copy of this resolution to Mrs. Helen Mastin.
4. Electronic equipment disposal for Canadice was discussed.
5. Approval of the Bills –

G. PRIVILEGE OF THE FLOOR:
1. Councilman O’Connor would like to petition the Board to research the stop sign locations in the Town and whether they should remain where they are currently. We also should post the yellow “reduced speed ahead” signs and “stop ahead” signs. He spoke to Mr. Tim McElligott from Ontario County Public Works and we have 40 to 48 hrs of their time for our use. But with cutbacks, they may not be able to do a traffic study in the near future. Mr. McElligott indicated we have two options at this point. Option one would be for the Town Board to send a formal request for the traffic study to Commissioner William Wright and the Board of Supervisors will vote on the request. The second option which might be faster would be to contact a private engineering firm to do a visual traffic study. Ontario County would provide to the private engineering firm all traffic counts, accident reports and do most of the leg work. The Board felt Councilman O’Connor should continue with the project to research the safest locations for all Town stop signs.
2. Superintendent Longbine asked if we have received an answer regarding the reduced speed limit request for Canadice Lake Road. Supervisor Singer has not received an answer.
3. Supervisor Singer mentioned the Ontario County Republican Committee’s Tasting on the Lake event will be held Sunday March 20th at The Inn on the Lake in Canandaigua from 2:00 until 5:00 pm.
