A. CONVOCATION:
1. The Canadice Town Board Meeting was held on May 14, 2012 at 7:30 pm at the Canadice Town Hall.
2. Roll call showed the following-

4. Approval of April 9, 2012 Regular Meeting Minutes-
Note: Minutes of the preceding meeting shall be approved without being read, unless the reading thereof is called for by a Member of this Board - the minutes are available for review at the Office of the Town Clerk.
Councilman Durkee motioned, Councilman O’Connor seconded, and it was unanimously carried to approve the minutes of the April 9, 2012 Regular Town Board Meeting.

Approval of April 23, 2012 Special Meeting Minutes-

B. PRIVILEGE OF THE FLOOR:
1. Mr. John Berry from Ontario County Department of Public Works addressed the Board regarding the upcoming planned inspection program. He indicated they are making preparations to implement a district wide inspection program for the Honeoye Lake County Sewer District to identify sources of storm water inflow into the sanitary sewers. Inflow is storm water/clear water that enters into the sewer system from foundation drains, sump pumps & roof drains and can quickly overload the system at the wastewater treatment plant.
Excessive inflow has been a problem in Honeoye during and after significant rainfall or snow melts. In the spring of 2011 an inspection showed flows exceeded the limit allowed on the permit from DEC. Notice of violation was issued. So a planned street by street and house by house building inspection of plumbing and basements throughout the district must take place. County personnel have the authority to enter homes for the purpose of these inspections. A leaflet will be sent out to advise residents of the situation; then notices to call the office and set up an appointment for the inspection. A part-time inspector will be hired to make inspections during the evenings and weekends.
*Councilman Virgil asked if any inspections took place when the sewers were installed and if follow up inspections will be done when this project is completed. Mr. Berry indicated that typically no inspections were done on the inside of the house when the sewers were initially installed and follow up inspections are not in the plan currently. Councilman Virgil asked if there is a penalty involved for violations; if so that might be good information for the leaflet. Mr. Berry indicated a fine schedule up to $250 per day for violations is already set up; however they would rather correct the situation.
*Councilman Durkee asked if any smoke testing will take place. Mr. Berry indicated it may happen in the future, but suspects most of the current issue is with sump pumps.
*Councilman Hershey asked if the waste water from water softeners can drain into the sewer. They aren’t allowed to drain into a septic system. Mr. Berry indicated the backwash from the softeners is questionable, but not sure if it’s a clear violation. Ontario County Code Enforcement Officer Mr. Bob Johnston indicated it depends on the system and what product is used to “clean” the water. Councilman O’Connor asked what the water softener backwash does to the septic system. Councilman Hershey indicated it deteriorates the system.
*Mr. Berry indicated they are in the process of creating the position for the part-time inspector. After leaflets are sent out district wide, late June would be the earliest any inspection letters would be mailed. They don’t expect to get to Canadice this summer.
*Councilman Hershey asked if there are leaks within the sewer districts own equipment. Mr. Berry mentioned they have been working at fixing leaks within their system with trenchless technology; probably 60% corrected at this point.
*Mr. Berry thanked the Board for their time.

6. Highway Superintendent- Mr. Bruce Longbine.
a. Equipment Replacement Schedule- will be reviewed at the next meeting.
b. There was a lengthy discussion on the cost of materials and where they will come from for the road projects in Canadice for 2012.
c. Councilman O’Connor indicated he took the Ford truck over to Auction Direct in Victor; their final offer was $22,801 after seeing it. We would have had to receive a bid of $25,331 at the Palmyra auction to equal Auction Directs’ offer by the time the auction house in Palmyra took their portion. So the truck was sold to Auction Direct.
7. Honeoye Lake Watershed Research Taskforce Liaison- Councilman Hershey.
a. There is a meeting scheduled for this coming Wednesday to go over the final report of the stream bank findings and the recommendations that came out of it. Some of which are sediment basins and retention ponds on both sides of County Road 36 that would be implemented on state or college owned property. Mr. Jack Starkey is retiring officially from the task force at this meeting and will tutor P.J. from Soil & Water on the reporting process for any grant that becomes available in the future.

b. Resolution Number 30 of 2012 – Budget Modification

WHEREAS, This Board contracted with Public Sector HR Consultants, LLC for services with Resolution Number 21 of 2012; and
WHEREAS, It was deemed necessary to contract for said services to conduct an unbiased investigation to resolve a complaint filed with the Supervisor; and
WHEREAS, The expenditure of funds for said services was not budgeted in the 2012 budget; and
WHEREAS, Additional expenses will be incurred relative to the investigation, now, therefore, be it
RESOLVED, That this Board directs the Budget Officer to make the following 2012 budget modifications to account for expenses incurred from the investigation:

1. Water District Update
a. Resolution Number 31 of 2012 – Requesting A Home Rule Bill To Be Formally Introduced In The Senate And Assembly

WHEREAS, The Town Board of Canadice ("Town Board") upon its own motion without a petition, pursuant to Article 12-A of the New York State Town Law, having moved to create and establish the West Lake Road/County Road 36 Water District, which would include certain real property located wholly in the Town of Canadice, County of Ontario, and State of New York; and
WHEREAS, In order to provide water service to the above referenced District, the Town of Canadice must contract with the Town of Richmond, to hook up to the Richmond water system and to purchase water from the Town of Richmond; and
WHEREAS, The Town Board of the Town of Richmond, New York has recently elected to enter into an agreement with the Monroe County Water Authority to have the Monroe County Water Authority lease and maintain Richmond's water system; and
WHEREAS, An amendment to the Monroe County Water Authority statute is required adding the Town of Richmond and the Town of Canadice to the existing list of municipalities whose water systems can be leased and maintained by the Monroe County Water Authority in order to proceed with the planned Water District and the relationship between the Town of Richmond and the Town of Canadice; and
WHEREAS, The attached letter to Assemblyman Sean T. Hanna and Senator Patrick M. Gallivan, requesting Home Rule Legislation was prepared at the direction of the Canadice Town Board; now, therefore, be it
RESOLVED, That the Town Board hereby directs a request for a Home Rule Bill to be formally introduced in the Senate and Assembly, asking that the Town of Canadice be added to the existing list of municipalities whose water systems can be leased and maintained by the Monroe County Water Authority.
2. Hydrofracking Legislation Update
a. County Model Hydrofracking Law – Supervisor Singer indicated the fee from the attorney drafting the model law is $6500 to be divided up between the towns that are interested. Even if only ten towns participate in the cost it would bring it down to $650 per town. The Board of Supervisors will look at approving the contract at their meeting the 31st. Each town can have their Planning Board look at the model law to adjust it for their specific needs.
b. April 15th information meeting in Hemlock – Councilman Virgil attended the meeting. An attorney, Mr. David Slottje gave the presentation and will offer free advice to municipalities on how to impose a moratorium and ban hydrofracking. The Supervisor of Livonia conducted the meeting.
3. Comprehensive Plan Update- Overview of the chapters with questions are as follows:
Appendix B
Chapter Two, pg 2, C – update to reflect the new water district.
Chapter Five, State Forest Watershed Protection Land Regulations – the town is paid by a pilot program. In our situation NYS makes payment to us under Real Property Tax Law section 532G.
Chapter Six- under housing assumption; “reflect” struck out and not sure why.
Chapter Seven- high priority implementation actions; may want to move the date out a couple of years.
Chapter Eight- checklist and other sections taken out; Board questioned why. Pgs 16, 17, & 18.
Supervisor Singer will print out these items for the Planning Board to review.
4. Resolution Number PULLED of 2012 – Modification Of Traffic Control Devises Within The Town Of Canadice In Accordance With Study Recommendations.
F. NEW BUSINESS:
1. Resolution Number 32 of 2012 – Authorization To Execute Appendix X Extending The Grant Period Pertaining To Contract No. T006806 With New York State

WHEREAS, There is a need to extend the contract period to complete the work identified and funded by the grant; and
WHEREAS, This Board, after discussion, agrees with the extension of the contract to enable completion of the prescribed work by the subcontracted entities; now, therefore, be it
RESOLVED, That this Board gives authorization to the Supervisor to execute said agreement; and, be it further
RESOLVED, That the Clerk of this Board forward three executed copies of the contract extension Appendix X with a copy of this resolution at which time a fully executed copy will be returned by New York State for retention in Town records.
2. Resolution Number 33 of 2012 – Authorization To Execute A One Time Services Agreement With Shred-It

WHEREAS, There is a need to purge stored records in accordance with the New York State Records Retention Schedule to eliminate the storage of unnecessary documents; and
WHEREAS, The Town Records Management Officer, Eileen Schaefer, recommends the use of Shred-it for onsite records destruction; and
WHEREAS, This Board, after discussion, agrees with the recommendation of the Records Management Officer to contract with Shred-it for secure records destruction services in accordance with New York State guidelines; and
WHEREAS, This Board agrees to the terms set forth in the agreement for services; now, therefore, be it
RESOLVED, That this Board gives authorization to the Supervisor to execute said agreement; and, be it further
RESOLVED, That the Clerk of this Board is to retain a copy of said agreement with this resolution in addition to retaining a certified copy of this resolution and an executed agreement for delivery to Shred-it at the time their services are scheduled.

G. PRIVILEGE OF THE FLOOR:
1. Councilman O’Connor provided the Memorial Day schedule for services as follows- 9:00 am in Bristol, 9:30 am in Hemlock, 10:30 am in Canadice and 11:00 am in Richmond for the parade with the memorial service to follow at the gazebo.
2. Councilman O’Connor is in charge of Graves Registration for the Honeoye-Hemlock American Legion and has information there is an old Civil War Veteran’s grave at Bald Hill Cemetery that has not been decorated before. That cemetery is located on private property. After some discussion, the property owner will be contacted for permission to place a flag on the grave even if the owners don’t want the whole cemetery restored.
3. Superintendent Longbine asked about ownership between the towns on Cross Road since they are planning on working this year on a small portion that is in Canadice. He already talked to the county and the state. The Board didn’t have any concrete information regarding ownership along the road. After some discussion, Superintendent Longbine indicated he will contact the Springwater Town Supervisor.
H. EXECUTIVE SESSION:

1. Resolution Number 32 of 2012 – Authorization To Execute Appendix X Extending The Grant Period Pertaining To Contract No. T006806 With New York State

WHEREAS, This Board applied for and was approved a grant from New York State relative to erosion control around Honeoye Lake identified as Contract No. T006806; and
WHEREAS, There is a need to extend the contract period to complete the work identified and funded by the grant; and
WHEREAS, This Board, after discussion, agrees with the extension of the contract to enable completion of the prescribed work by the subcontracted entities; now, therefore, be it
RESOLVED, That this Board gives authorization to the Supervisor to execute said agreement; and, be it further
RESOLVED, That the Clerk of this Board forward three executed copies of the contract extension Appendix X with a copy of this resolution at which time a fully executed copy will be returned by New York State for retention in Town records.
2. Resolution Number 33 of 2012 – Authorization To Execute A One Time Services Agreement With Shred-It
Councilman Durkee motioned, Councilman Hershey seconded, and it was unanimously carried to approve the resolution.

WHEREAS, There is a need to purge stored records in accordance with the New York State Records Retention Schedule to eliminate the storage of unnecessary documents; and
WHEREAS, The Town Records Management Officer, Eileen Schaefer, recommends the use of Shred-it for onsite records destruction; and
WHEREAS, This Board, after discussion, agrees with the recommendation of the Records Management Officer to contract with Shred-it for secure records destruction services in accordance with New York State guidelines; and
WHEREAS, This Board agrees to the terms set forth in the agreement for services; now, therefore, be it
RESOLVED, That this Board gives authorization to the Supervisor to execute said agreement; and, be it further
RESOLVED, That the Clerk of this Board is to retain a copy of said agreement with this resolution in addition to retaining a certified copy of this resolution and an executed agreement for delivery to Shred-it at the time their services are scheduled.

G. PRIVILEGE OF THE FLOOR:
1. Councilman O’Connor provided the Memorial Day schedule for services as follows- 9:00 am in Bristol, 9:30 am in Hemlock, 10:30 am in Canadice and 11:00 am in Richmond for the parade with the memorial service to follow at the gazebo.
2. Councilman O’Connor is in charge of Graves Registration for the Honeoye-Hemlock American Legion and has information there is an old Civil War Veteran’s grave at Bald Hill Cemetery that has not been decorated before. That cemetery is located on private property. After some discussion, the property owner will be contacted for permission to place a flag on the grave even if the owners don’t want the whole cemetery restored.
3. Superintendent Longbine asked about ownership between the towns on Cross Road since they are planning on working this year on a small portion that is in Canadice. He already talked to the county and the state. The Board didn’t have any concrete information regarding ownership along the road. After some discussion, Superintendent Longbine indicated he will contact the Springwater Town Supervisor.
H. EXECUTIVE SESSION:
Councilman O’Connor motioned, Councilman Durkee seconded, and it was unanimously carried to adjourn into executive session to discuss the employment history of an individual and related pending litigation at 9:00 pm.
