May 2011 Meeting
A. CONVOCATION:
1. The Canadice Town Board Meeting was held on May 9, 2011 at 7:30 pm at the Canadice Town Hall.
2. Roll call showed the following-

4. Approval of April 11, 2011 Regular Meeting Minutes-
Note: Minutes of the preceding meeting shall be approved without being read, unless the reading thereof is called for by a Member of this Board - the minutes are available for review at the Office of the Town Clerk.
Councilman O’Connor motioned, Councilman Durkee seconded, and it was unanimously carried to approve the minutes of the April 11, 2011 Regular Town Board Meeting;

B. PRIVILEGE OF THE FLOOR:
1. Mr. Michael Schaffron, LaBella Associates, P.C. Proposed Water District.
Since the information meeting we made a few adjustments. If there is more then one dwelling unit, the first is assessed one benefit unit and any additional dwelling units are ½ of a unit. An estimated number of 402.5 dwelling units will be used. The mobile home park will have occupied pads counted, so it will be a changing number.
The bond repayment schedule has been received from the financial advisor at Bernard P Donegan, Inc., Mr. Chuck Bastian. The annual cost for the principal and interest payments have shifted by $9.00 changing the $1100 per year to $1109 per year. Also the few properties that are not buildable lots were excluded from the district.
Mr. Schaffron is leaving two copies of the completed map, plan & report that will be accepted at this meeting for the Town Supervisor, two copies to the Town Clerk (one for the official file and one for public viewing) and two copies were mailed to the Attorney. At the Public Hearing Mr. Schaffron will have the slide presentation available to refer to if we need it. He will also bring a screen. The SEQR application was reviewed.
Supervisor Singer mentioned the article from The Livingston County News regarding South Lima researching a water district and the annual household cost is estimated at $1,137.
a. Resolution Number 29 of 2011 – Resolution To Act As Lead Agency For SEQR Review In Connection With The Formation Of The Canadice Water District #1
Councilman Durkee motioned, Councilman Virgil seconded, and it was unanimously carried to approve the resolution.

WHEREAS, The Town Board of the Town of Canadice having upon its own motion without a petition, pursuant to Article 12-A of the New York State Town Law, moved to create and establish Canadice Water District #1, which would include certain real property located wholly in the Town of Canadice, County of Ontario, and State of New York; and
WHEREAS, The real property that will be located in the district is more particularly described in the map, plan and report filed in the Canadice Town Clerk’s Office; now, therefore, be it
RESOLVED, That the formation of the water district at issue is an action that is subject to SEQR review; and, be it further
RESOLVED, That the action is an unlisted action pursuant to 6NYCRR 617; and, be it further
RESOLVED, That there are no other agencies that are required to be involved in the SEQR review, and as a result, the Town of Canadice shall act as lead agency for SEQR review, and shall conduct the review accordingly.
b. Resolution Number 30 of 2011 – Resolution To File Map, Plan And Report And To Publish A Legal Notice Of Public Hearing To Receive Comment On The District Formation of Canadice Water District #1

WHEREAS, The Town Board of the Town of Canadice having upon its own motion without a petition, pursuant to Article 12-A of the New York State Town Law, moved to create and establish Canadice Water District #1, which would include certain real property located wholly in the Town of Canadice, County of Ontario, and State of New York; and
WHEREAS, The real property that will be located in the district is more particularly described in the map, plan and report to be filed in the Canadice Town Clerk’s Office; now, therefore, be it
RESOLVED, That pursuant to New York State Town Law, a public hearing be held on the 13th day of June, 2011 at 7:30 pm at the Canadice Town Hall at 5949 County Road 37, Springwater, New York, 14560, with respect to the formation of Canadice Water District #1, to include the property noted in the map, plan and report filed in the Canadice Town Clerk’s Office and as more particularly described in the map, plan and report on file in the Canadice Town Clerk’s Office; and, be it further
RESOLVED, That the maximum amount proposed to be expended for the improvements is $4,240,000.00, to be financed by way of bond anticipation notes and serial bonds; and, be it further
RESOLVED, That the anticipated cost to the typical property located within the district is estimated to be $1,109.00; and, be it further
RESOLVED, That a copy of the map, plan and report describing the proposed district formation and the improvements to be constructed therein shall be available for public inspection at the Canadice
Town Clerk’s Office; and, be it further
RESOLVED, That the Clerk of this Board publish a notice of said Public Hearing in the official newspaper of the Town at least five (5) days prior thereto; and, be it further
RESOLVED, That at the time and date aforementioned, all interested parties may be heard
concerning the proposed Water District formation.
2. Mr. Mayhood asked if there were dates scheduled for yard trash disposal yet. Supervisor Singer indicated it had not been scheduled yet.

1. Town Clerk/Tax Collector- Mrs. Eileen Schaefer.
a. The financial report for the Town Clerk/Tax Collector for the month of April was submitted (see T. C. file).

a. The April draft minutes will be submitted. We had a preliminary on the Sanford subdivision and received a site plan application for the property on Ranch Road owned by Mr. & Mrs. Costanza.
b. Report from Ontario County Planning meeting indicates the Town of Victor is looking at establishing a planned development district with approximately 122 housing units.
5. Zoning Board of Appeals- Mrs. Linda Moorhouse.
a. The draft minutes of the April ZBA meeting were submitted (see T.C. file).
6. Highway Superintendent- Mr. Bruce Longbine.
a. FEMA called to get costs related to storm damage. Ours totaled approximately $6,500.
b. Meeting Bill Wright and Tom Harvey to discuss the radio issue.
c. Received a couple of price quotes on the Highway Department shed building repair. However one is incomplete and waiting for the third quote to come in.
7. Honeoye Lake Watershed Research Taskforce Liaison- Councilman Hershey.
a. Nothing new to report.
8. Assessor- Ms. Valary Muscarella.
a. The written report for the month of April was submitted (see T. C. file).

WHEREAS, The Budget Officer has determined that the Personnel appropriations line does not contain enough revenue for meeting the expenses that will be paid from this line for 2011; and
WHEREAS, The sales tax revenue for the first quarter exceeded the budgeted amount resulting in excess funds; and
WHEREAS, The Budget Officer recommends a budget modification to address the shortfall in the Personnel account; now, therefore, be it
RESOLVED, That this Board directs the Budget Officer to make the following 2011 budget modifications:
Increase A1120, Non Property Tax Distribution by $1,100.00
Increase A1430.4, Personnel - Contractual by $1,100.00
E. UNFINISHED BUSINESS:
1. Resolution Number 32 of 2011 – Acceptance of Bid
Councilman O’Connor motioned, Councilman Durkee seconded, and it was unanimously carried to approve the resolution.

WHEREAS, This Board established an Equipment Replacement Schedule in order to maintain the efficient and cost effective operation of the Canadice Highway department; and
WHEREAS, In accordance with said replacement schedule Resolution 17 of 2011 authorized the solicitation of bids for the sale of the crew pick up truck; and
WHEREAS, It was determined to advertise and solicit bids for the disposal of the surplus pickup for opening on April 7, 2011; and
WHEREAS, No bids were received by April 7, 2011 at 4:00 pm; and
WHEREAS, This Board agreed to authorize another request for bids prior to sending the truck to auction; and
WHEREAS, A bid in the amount of $850 was received from Mr. Steven Zeh which exceeded the minimum bid required of $750; and
WHEREAS, This Board has determined that this bid is within the limits of the approved equipment replacement plan; now, therefore, be it
RESOLVED, This Board authorizes the Supervisor to accept the bid in the amount of $850 for the crew pickup truck and execute all necessary documents for transfer of the vehicle; and, be it further
RESOLVED, That the Clerk of this Board send a copy of this resolution to Highway Superintendent Bruce Longbine.
F. NEW BUSINESS:
1. Phone Bill Review
a. Resolution Number 33 of 2011 – Authorization To Execute An Agreement With PhoneReview
Councilman O’Connor asked if we still needed land lines. Councilman Virgil indicated the listing would not be in the phone book possibly and internet access would still be needed. Supervisor Singer indicated our high speed internet access and fax lines are through land lines. Mr. Pipitone indicated he had a credit card compromised by not using a land line phone.
Councilman Durkee motioned, Councilman O’Connor seconded, and it was unanimously carried to approve the resolution.

WHEREAS, The Town Clerk and Supervisor received information from PhoneReview pertaining to their services; and
WHEREAS, PhoneReview will review the past three years of town phone bills in an effort to identify over-charges and tax charges assessed that a municipality is legally exempt; and
WHEREAS, PhoneReview will provide services for a fee based on the savings realized from the audit; and
WHEREAS, This Board agrees it is in the best interest of the Town to have an audit of our phone expenses to ensure we only expend funds on necessary charges; now, therefore, be it
RESOLVED, That this Board directs the Supervisor to execute the agreement with PhoneReview; and, be it further
RESOLVED, That the Clerk of this Board send a copy of this resolution, and copy of the executed agreement to PhoneReview.
2. Computer replacements and upgrades – Just an FYI, Supervisor Singer has met with some IT people to get estimates for replacement or upgrades to our computers. The Town Clerk’s computer went down just before the last storm and needed a new power supply unit. Also with the programs that are running on the Assessor and Town Clerk computers, upgrades are needed in the near future.
3. Approval of the Bills –
Councilman O’Connor motioned, Councilman Durkee seconded, and it was unanimously carried that the bills are to be paid in the following amounts:

G. PRIVILEGE OF THE FLOOR:
1. Councilman O’Connor reported on the traffic study/stop sign issue. The engineering firm out of Honeoye Falls needs approval from the Board to prepare an estimate of the cost of the study. They need specific information from Ontario County, the Sheriff’s Department and the intersections in question.
After a brief discussion, Councilman Durkee motioned, Councilman Virgil seconded and it was unanimously carried to approve the motion to prepare an estimate/quote for a traffic study for three intersections- 1) Burch Hill Rd & Canadice Lake Rd; 2) Canadice Lake Rd & Purcell Hill Rd; 3) Middle Rd & Burch Hill Rd

2. Councilman O’Connor provided the Memorial Day schedule for services as follows- 9:00 am Bristol, 9:30 am Hemlock, 10:30 am Canadice and 11:00 am in Richmond. The parade in Richmond may start from Honeoye Central School and end at the gazebo instead of starting from the UCC Church due to the bridge repair work.
3. Councilman Hershey asked what was involved with the timeline for the referendum vote. After some discussion it was decided Saturday August 20th from 8:00 am until 4:00 pm would fit the criteria.
4. Supervisor Singer announced the Republican Caucus will be the evening of June 15th at the Canadice Highway Department building.

G. PRIVILEGE OF THE FLOOR:
1. Councilman O’Connor reported on the traffic study/stop sign issue. The engineering firm out of Honeoye Falls needs approval from the Board to prepare an estimate of the cost of the study. They need specific information from Ontario County, the Sheriff’s Department and the intersections in question.
After a brief discussion, Councilman Durkee motioned, Councilman Virgil seconded and it was unanimously carried to approve the motion to prepare an estimate/quote for a traffic study for three intersections- 1) Burch Hill Rd & Canadice Lake Rd; 2) Canadice Lake Rd & Purcell Hill Rd; 3) Middle Rd & Burch Hill Rd

2. Councilman O’Connor provided the Memorial Day schedule for services as follows- 9:00 am Bristol, 9:30 am Hemlock, 10:30 am Canadice and 11:00 am in Richmond. The parade in Richmond may start from Honeoye Central School and end at the gazebo instead of starting from the UCC Church due to the bridge repair work.
3. Councilman Hershey asked what was involved with the timeline for the referendum vote. After some discussion it was decided Saturday August 20th from 8:00 am until 4:00 pm would fit the criteria.
4. Supervisor Singer announced the Republican Caucus will be the evening of June 15th at the Canadice Highway Department building.

Councilman O’Connor motioned, Councilman Durkee seconded, and it was unanimously carried to adjourn the meeting at 8:55 pm.
